Current cases

Northumberland solicitors were involved in one the most important cases regarding stress and employer’s liability. The case of Walker v Northumberland County Council helped establish the standard of care an employer must abide by in order to avoid liability for an employee’s stress related psychological harm. Walker was a social worker who dealt with child abuse cases. He had complained about stress related to an increase in his workload, and asked for a different structure to be put in place. His request was denied and following that he had suffered a nervous breakdown. After he returned to work he was appointed an assistant to help with the workload, but the assistant was not available for periods of time and did not improve the situation enough. Walker then suffered a second nervous breakdown and was forced to retire.

The court found that although the first breakdown could have been avoided, the employer was not liable for the damage caused. The second nervous breakdown should have been avoided however, because the County Council was aware of the risk of stress-related injury to the employee.
