Using motoring solicitors for a criminal offence

Being convicted of a serious motoring offence can result in a ban from driving. For some people the loss of their driving licence amounts to a loss of livelihood.

Even the most minor offences can lead to points being added to your licence, and ultimately to disqualification from driving if these points accumulate through a number of infringements.

Call us on 0800 046 1464 if you wish to contest a motoring offence and need the help of a qualified, specialised motoring lawyer.

What are motoring offences?

Clearly, there may be times when you understand that your speeding fine or parking ticket is justified. At other times, however, you may feel punishment for a certain offence was unjustified, and you decide to challenge a motoring penalty. There may well be mitigating circumstances.

In those situations it is certainly advisable to consult motoring solicitors to find out what your position is with regard to the law, and how you would go about mounting a challenge to the conviction.

Motoring solicitors can consider the details of your claim and tell you whether your case is worth pursuing in the courts. It is especially important to take legal advice when you admit the offence but wish for mitigating circumstances – usually an emergency – to be taken into account.

Motoring offences include:

  • Drink driving
  • Speeding
  • Using a mobile phone while driving
  • Failure to stop after an accident
  • Dangerous driving
  • Contravening traffic signals/traffic lights

What can a motoring solicitor do?

If you are charged with a motoring offence you should immediately instruct a firm of lawyers dealing with motoring issues, who will possibly be able to help you to:

  • Avoid being charged
  • Avoid having points added to your license
  • Avoid having your licence taken away from you

Consider, for example, a speeding offence that will give you three points on your licence and result in you losing your licence and as a result losing your job. Firstly, lawyers adept in dealing with motoring offences will consider the legality of the charge.

The type of camera used may have an effect on whether the charge is legitimate, as might:

  • The state of the machinery
  • The health of the person operating the machinery
  • Even the weather can have an effect

If the motoring offence is to stand, then motoring lawyers can prepare an argument for the court explaining the great adverse effect on the life of your family if you lose your job. If your solicitor is able to prove, on the balance of probabilities, that mitigating circumstances exist, then the magistrates are able to refrain from disqualifying you, if they so desire.

Check with your motoring solicitors about the fees they charge. For defending motoring cases, solicitors will often charge a fixed fee because the timings and procedures involved are relatively predictable. As well as putting you in touch with motoring solicitors, we can also advise on other types of law and any claim you might wish to make.
