How to contest speeding tickets

Speed cameras police many of the roads in the UK, and if you drive over the maximum speed limit set for any particular road, you could receive a speeding ticket. The speed cameras generate what are called fixed penalty fines.

Penalties for speeding tickets

Currently, if you are caught speeding by a camera, you will receive a fixed penalty fine of £60 and three points on your licence via a ‘Notice of Intended Prosecution’ that you will receive in the post within 14 days of your speeding offence.

Contesting speeding tickets

You have up to 28 days to pay any fixed penalty fine you have received. If you do not, the fine will increase by 50 percent. You will also be issued with a summons to attend court. If you want to contest a speeding ticket you have received, you can do this via the courts without waiting for a summons to arrive.

To contest a speeding ticket you have to prove that the evidence that your speeding offence is based on is faulty in some way. Check the details of your ticket:

  • Were you actually using that road at the time the speed camera photographed your car?
  • Are all the proper warning signs about the speed cameras on the road legible?

The police have many mobile speed camera units they use to spot-check some roads. In these cases it is important to have fully qualified legal representation at every stage of your case.

Contesting speeding tickets at court

If you intend to contest your speeding ticket, the police will issue you with a summons. It is at this point that legal representation becomes vitally important. Your case will come before the court, which has the power to increase your fine and also the number of penalty points put on your licence if you are found guilty. Any contest of a speeding ticket will usually take place at your local magistrate’s court.

Getting legal representation

The court will want to see documentary evidence to support your dispute. Your car will be identified by its number plate. If you were not driving your car at the time of the alleged speeding offence, you will need to prove this. A solicitor has the experience to know what reasons the court will and will not accept when contesting speeding tickets.

Your solicitor can help and support you at every stage of your court hearing to give you the best chance of winning your case.
