European property laws


European property laws may differ significantly from those in the UK. They will be of particular concern to anyone wishing to buy or sell property abroad as well as those in the buy-to-let or rentals market.

However, there are numerous situations in which you might deal with property laws beyond merely letting, buying or selling. European property laws can also affect how you use the land and something as simple as walking over a path could cause legal problems.

Where are you based?

If you face a property-law problem abroad, or realise that you may do in the future, it is best to start by considering where you will reside whilst dealing with the issue. Like in the UK, European property laws issues may take time to resolve and could depend on a lot of processing and waiting.

You should have good and frequent communication with your property solicitor, therefore it is advisable to instruct a solicitor local to where you reside. If this is within the UK then you will need to instruct a specialist solicitor with knowledge of either European property laws or simply experience of the laws of the country in which your property is or will be situated.

Finally, bear in mind how you will use this overseas property and discuss your options for the property’s future with your solicitor. If you have more than one property abroad it may be worth instructing the same solicitor to advise you on all of them, provided that solicitor has enough local legal experience and knowledge.
