Driving without insurance

Driving without insurance is a strict liability offence which can potentially be tried in court. It is treated as a serious breach of the law due to implications in the event of a crash, as accidents involving uninsured drivers cost an estimated £400 million per year (according to the Motor Insurers’ Bureau). These accidents can also impact the cost of insurance for other drivers.

The burden of proof falls on the defendant who has to prove they were insured. If they cannot successfully prove this, then they will be handed a Fixed Penalty Notice, requiring payment of £200 and endorsing their license with 6 penalty points. Alternatively, they can be summoned to court, where they can expect a fine up to £5,000 and 6 to 8 points and even potentially suffering disqualification from driving.

The car will be withheld until proof of insurance is displayed.

Reckless driving

Reckless driving is driving that could be the direct cause of an accident on a public road. There are different kinds of driving included in the definition of reckless driving, such as speeding, tailgating and driving without due care and attention.

The objective test of whether a driver has fallen below the required standard for driving applies either for when the driver is deliberately driving recklessly or due to incompetence, or even inexperience.

Even driving whilst over-tired could be considered as reckless driving.

The maximum penalties are:

  • A £2,500 fine
  • Mandatory 3 to 9 penalty points
  • Discretionary disqualification from driving
