What is a copyright?

A copyright is an unregistered right that exists from creation of a certain category of work provided certain criteria are met. Under the Copyright, Designs and Patents Act 1988 copyright works can only fall into the following categories:

  • Original literary works
  • Original dramatic works
  • Original musical works
  • Original artistic works
  • Films/sound recordings/broadcasts
  • Typographical arrangements of published editions

These are closed categories and unless a work falls within these categories no copyright can exist. Even if a work falls within these categories further criteria must be met in order for copyright protection to arise.

In the ‘artistic industries’ including writers, painters, designers, film directors, journalists, and architects (amongst others), copyright is of fundamental importance as it the legal right through which authors can exploit their works and go on to make a profit. However, copyright applies to all industries provided that the work involved is sufficiently original for copyright to subsist.

There must be 'fixation', meaning the work must be recorded by some way by:

  • Writing or drawing it on paper
  • Saving it on audio tape or digitally

A work must be original and this does not have anything to do with whether it is entrepreneurial, creative or artistic. Rather it means the work must be independent work which must have originated from its author or creator as opposed from being copied from somewhere else.

Works must also be created by a UK citizen in order to attract UK copyright. However, citizens of signatory countries to the Bern Convention and the Universal Copyright Convention will also qualify for UK copyright.
